Your privacy is very important to the Sky Ute Casino Resort (“SKY UTE”, “we” or “us”), operator of a sports book and a mobile sports betting app, all described on the website: (the “Site”).   This privacy policy (“Privacy Policy”) governs your use of the Site (mobile and online versions), the Sky Ute Mobile App, and any other devices, services and features owned, operated or controlled by Sky Ute that it makes available to its customers. This Privacy Policy does not govern third parties over whom we have no control such as advertisers who may offer products, services, or otherwise interact on the Site.

The terms of this Privacy Policy may change. Therefore, please refer back to this Privacy Policy regularly and review all notices regarding changes to it that we may send out. In addition, please review in conjunction with this Privacy Policy the Sky Ute Terms of Use (“Terms”). By using the Services, you consent to the Privacy Policy and Terms of Use.

SKY UTE is operated by the Southern Ute Indian Tribe, (the ”Tribe”), a federally recognized Indian Tribe, and is licensed and regulated by the Southern Ute Department of Gaming (“SUDOG”).  SKY UTE offers real-money casino sports wagering, and mobile online interactive sports gaming services (“Services”) in the state of Colorado from its location on the Southern Ute Indian Reservation where sports betting is legal.  The SKY UTE Services provided to you are set forth in the Terms of Use and serve as the agreement between SKY UTE and you for your participation in SKY UTE Services. This Privacy Policy is governed by the laws of the Southern Ute Indian Tribe.

We are committed to maintaining the confidentiality of the personal information collected by us by safeguarding it utilizing software and hardware architecture, techniques, methods, and procedures which allow you to enjoy the product menu available on our Site with the knowledge that your privacy is safeguarded. We will comply with all applicable governmental legal, regulatory or administrative requirements.

1. Consent to Privacy Policy

By using the Services, you (“User” or “you”) agree to the terms of this Privacy Policy. We reserve the right to amend this Privacy Policy and changes will come into effect immediately upon notice of such change being provided on the Sky Ute Site or App. Your continued use of the Services constitutes your agreement to this Privacy Policy and any amendments to the same thereinafter.  The purpose of this Privacy Policy is to enable you to understand how we collect, store, use and safeguard your personal information and for you to understand your rights in relation to that information. References to defined terms hereunder, if not specified, shall have the same meaning as set out in the Terms.

2. What information is collected and for what purpose

As part of the Sports Wagering Account opening process explained on the Site and in the Terms to allow us to provide our services to you, you must provide us with certain personal information, including but not limited to your name, date of birth, social security number, postal address, telephone number, e-mail address and password as well as to certify that you are at least 21 years old. You are reminded that you can only use the Services if you are physically present in the state of Colorado or on the Southern Ute Indian Reservation. In order for you to access and use the Services, you hereby consent and permit us (or third parties acting on our behalf) to: (i) use location-based services (“LBS”) to detect your geographic location from your mobile device (which may include but not be limited to your IP address, Wi-Fi connection and cookies data), and (ii) undertake the collection, storage, processing, review, retrieval and transmission of your personal information (which will include, but not be limited to, your location data) and/or such other data or information that may be derived from your Device (as defined in paragraph 9 below), to enable you to access and use the Services, all in accordance with the purposes set out in this Privacy Policy. We may also use any or all of your personal information to verify your credentials from third parties including financial institutions, identification verification agencies and credit reference agencies for the purposes of providing services to you. In addition, when you use the Services we store certain personal information, including information about your activity on the Site and information held on or derived from mobile devices that you use to allow us to enhance the Services that we provide to you as well as to ensure that you are not using any prohibited third party software or tools.

We will do our best not to collect or store information regarding children. Use of our Services is prohibited for those under 21 years of age. If you learn that we have collected or stored information of a child, please contact us immediately.

We, our affiliates, and third parties providing services on our behalf, will use your personal information for various purposes such as:

to confirm financial transactions,

to provide services to you;

identification, verification and vetting purposes;

statistical analysis and research;

research and development;

marketing, market research and customer profiling;

data analysis;

to comply with licensing and regulatory requirements;

to assist third parties who provide services to us or on our behalf;

for the purposes of any third party that purchases us or our business or any part of us or our business;

to assist credit reference agencies as described in the circumstances described below in this paragraph 2;

with your consent;

for the purposes of disaster recovery; or

as set out in paragraphs 5 and 6 below.

We may occasionally send you details of future events and news information about a range of our products, promotional links and other marketing communications regarding the Services that we offer. If you no longer wish to receive such promotional notifications, you may opt-out of receiving them by following the instructions given when you receive such messages.

Your personal information may be processed by us, our affiliates, our agents and third parties providing services to us, in jurisdictions outside of the United States of America. In this event, we will comply with the terms of applicable legislation in force in relation to any such processing and/or transfers of your personal information. By accepting this Privacy Policy, you hereby consent to your personal information being shared, where necessary, outside of the United States of America.

We will only use your name in publicity materials with your consent.

The name you register with us must be your own name. In addition, it is very important that you complete the account details with valid information since it will be used while validating financial transactions and for other purposes. 3. Deposit and withdrawal processing

When making a deposit, Users will need to provide deposit method information (example: credit card number). You are required to advise us of, and update your Sports Wagering Account with, any relevant changes to your personal information, by emailing us at Customer Support at

4. Confidentiality

SKY UTE undertakes commercially reasonable efforts to protect the confidentiality of the identity, preferences and other information it has collected about individual Users and will not knowingly allow access to this information by anyone other than the User or as described in this Privacy Policy. SKY UTE and its affiliates and third parties acting on its behalf have made investments in their servers, database, backup, firewall and encryption technologies to protect the information collected by them. These technologies are deployed as part of their security architecture.

However, no security measures can be completely guaranteed.  Therefore, you should also do your part in protecting your information. Your Login Credentials are confidential, and you are obligated to keep your Login Credentials secret and confidential at all times and to use your best efforts to protect their secrecy and confidentiality.

5. Limits of Confidentiality

Legally Required Disclosures: Due to the legal, regulatory and security environment in which we operate, SKY UTE may be required, under certain circumstances, to disclose personally identifiable information about its Users for purposes other than as describe herein and it may not be permitted to inform you that it has done so. SKY UTE will use its reasonable efforts to limit such disclosure to the following:

where it believes, in good faith, that it is required to do so in response to a subpoena, warrant or other legal process; or

where reasonably necessary to identify, contact or bring legal action against persons or entities to preserve and/or enforce its rights.

Further, we can, and you authorize us to, disclose your User identification, name, date of birth, age, street address, city, state, zip code, phone number, e-mail, geo-location data plus details of financial instruments used to deposit and withdraw funds to our third party agents or official government bodies as we, in our sole discretion, believe necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy or other unlawful activity, activity that may expose us to legal liability, or as otherwise may be required by law or as necessary to carry out the purpose of the Agreement and Privacy Policy.

6. Who receives your information?

In addition to legally required disclosures as explained in this Privacy Policy, we may disclose your personal information to our employees, agents, and third party service providers who use your personal information to provide services to us in respect of your being a User with SKY UTE. All recipients of your personal information shall be bound by applicable data protection laws to keep your personal information confidential and safeguard it at no less a level than that by which we are bound.

We may combine your personal information collected from your use of the Services in accordance with this Privacy Policy with other information collected from you using other services operated by SKY UTE or any of its affiliates as well as all products which are related or ancillary thereto, including mobile and social networking sites. We will treat this combined information in accordance with, and will use it for, the purposes set out in this Privacy Policy.

7. Direct Marketing

We may use your email address and phone number to provide you with news, promotions and other marketing offers from SKY UTE. We may also share your email address and phone number with our marketing partners to provide you with marketing offers. Out of respect for your right to privacy we have provided you with an easy means by which you may stop receiving marketing offers via email and telephone from us or from our partners and affiliates. You may request at any time to no longer receive such offers by sending a blank message with the word “Remove” or “Stop” in the subject area at   If you request to discontinue receiving marketing communications about our offers, we will remove your details from our marketing distribution lists and from any future lists we may share with our marketing partners. However, you may need to unsubscribe separately from marketing offers sent by partners who have received your contact details from us prior to your request to be removed from these lists.

8. Your rights in relation to your information

We aim to keep our information about you as accurate as possible. You can write to us at any time to review, change, or have your details altered or corrected in accordance with your rights under applicable legislation and in this event, we may require evidence of your identity. Please note that if we close or if you request us to close your Gaming Account for any reason, your personal details will be retained for such period as may be required under applicable anti-money laundering regulations or other license and/or regulatory requirements.
